SCNI stock: Scanner Technologies Receives Favorable Ruling from Court of Appeals
Scanner Technologies Corporation (OTCBB:SCNI stock) today announced that it
received a favorable ruling from the United States Court of Appeals for
the Federal Circuit.
In 2007 the U.S. District Court for the Southern District of New York
found several of Scanner’s patents related to
BGA manufacturing unenforcable due to “inequitable
conduct” before the U.S. Patent Office and
ordered Scanner to pay ICOS Vision Systems N.V. fees and costs of $3.4
million.
Scanner appealed that decision, and the Court of Appeals heard oral
argument on May 9, 2008 and ruled on June 19, 2008. The ruling reversed
the New York Court’s judgment that Scanner’s
patents are unenforceable due to inequitable conduct, and vacated the
award of attorneys’ fees. However, the Court
of Appeals affirmed decisions of noninfringement and invalidity of U.S.
patents 6,064,756 and 6,064,757 owned by Scanner.
In its ruling, the Court of Appeals stated, “we
reverse the district court on its inequitable conduct finding, and its
judgment that the related, unasserted patents are unenforceable.
Consequently, we vacate the attorneys’ fee
award. We affirm the district court’s judgment
that claim 1 is invalid as it would have been obvious. We also affirm
the district court's judgment invalidating all claims of the patents in
suit given the stipulation between the parties that the case would be
tried on a representative claim. We also affirm the district court’s
holding that the CyberSTEREO does not infringe any claim of the patents
in suit generally, and the ‘756 patent
specifically.”
